Mt Buller & Mt Stirling Resort Opening Photography Competition Terms and Conditions

1. Who can enter

1.1. The competition is open to all residents of Australia and entry is free.

1.2. There is no age limit on entering the competition. Participants under 16 years of age a parent or guardian consent is required. The consenting guardian is then bound by these Terms and Conditions.

1.3. Entrants are requested to be present at the awards ceremony at Mt Buller Cinema on 11 November 2023.


2. How to enter

2.1. Entries will be accepted from 13 October 2023 until 5:00pm 3 November 2023. No entries will be accepted after this time. There is no fee to enter.

2.2. The Promoter is not responsible for any misdirected, late or incomprehensible entry.

2.3. Entrants are responsible for their own costs of participating. The Promoter will not be responsible for any costs associated with an entrants participation in the competition.

2.4. Entrant registration and photo description details must be true and accurate.

2.5. Entrants must choose the appropriate category for their image. The same image cannot be entered into more than 1 category.

2.6. The image categories are:

a. Alpine Flora/fauna

b. Alpine Landscape

2.7. The age categories are:

a. Under 18 years (at the time of submitting)

b. 18 years or over

3.1. Entries must comply with the following requirements:

a. Taken within the Mt Buller and Mt Stirling Alpine Resort during the green season (October to May) no earlier than 2019.

b. Must be an original photograph produced entirely by the entrant.

c. Image saved as a high resolution JPEG file.

d. Image size must be between 2MB and 50MB.

e. No image watermark or branding

3.2. The Promoter collects entrant personal information for the purpose of conducting and promoting the competition (including but not limited to determining and notifying winners).


3. Exhibition

3.1. As many entries as possible will be shown on the Mt Buller Cinema Screen on 11 November 2023.

3.2. If the number of entrants exceeds the exhibition time available the Promoter reserves the right to only exhibit shortlisted entries.

4. Deliberation and judging

4.1. The Promoter will establish a panel of judges to judge entries and determine which entries should receive an award in each category and age group (the winners).

4.2. The decisions from the panel are final and not subject to appeal or other objection.

4.3. The winners and prizes will be announced at the end of exhibition on 11 November 2023. Winning entries will also be published through the Promoter’s communication channels including website, newsletter and social media.

4.4. Entrants that communicate or correspond with judges during the competition period will be disqualified if there is any actual or reasonably perceived impact on the probity of the event.


5. Prizes/Awards

5.1. Prizes will be determined during the competition.

5.2. Prizes will be awarded as follows:

6.1.1. Flora/fauna under 18 years: first place and runner up

6.1.2. Flora/fauna over 18 years: first place and runner up

6.1.3. Landscape under 18 years: first place and runner up

6.1.4. Landscape over 18 years: first place and runner up

6.1.5 Overall winner (all categories/age groups combined).

5.3. The Promoter reserves the right to award additional or extra prizes for merit.

5.4. Prizes are not transferable or exchangeable. The Promoter may disclose the winner’s name and contact details with a business engaged for prize fulfilment.


6. Rights

6.1. It is a condition of entering the competition that entrants grant the Promoter use of images through the Promoter’s communication channels including Buller and Stirling and other relevant websites, social media, brochures, newsletters etc.

6.2. All copyright remains with the entrant. The Promoter will not licence or otherwise give permissions to any third party to use of the photograph for any purpose. The Promoter will not be liable for any third-party misuse of images.


7. Website and submission portal

7.1. The Promoter has taken all reasonable steps to ensure the submission portal is safe and free from virus, malware etc.

7.2. The Promoter accepts no responsibility or liability for any failure, technical error or other technical issue or impact associated with the submission portal.

7.3. The Promoter accepts no responsibility or liability for any theft, unauthorised access or distribution of any entries.

7.4. Entrants must not use the submission portal in appropriately including any hacking, theft or improper use of information such as distribution, promotion, modification or use for commercial benefit.

7.5. The submission portal collects registration information including the date, time and IP address for each use and pages accessed and documents downloaded/uploaded. This information is used to administer the portal safely, diagnose and resolve problems. De-identified and aggregated data may also be used to improve the portal, website and for marketing purposes.

7.6. Some parts of the submission portal may use cookies to maintain contact through a session. The cookies do not collect any personal information. If you prefer not to receive cookies, you can adjust your internet browser to refuse cookies or to warn you when cookies are being used. Refusal may make some parts of our websites inaccessible, unusable, or not function correctly.

7.7. The submission portal and Promoter websites include links to other sites. The Promoter is not responsible for the privacy practices or the content of other websites or social media platforms etc.


8. Liability and Governing Law

8.1. The competition is governed by the laws of Victoria.

8.2. Nothing in these Terms and Conditions limit, exclude or modify the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth) or other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in Victoria and Australia.

8.3. The Promoter limits its liability or any remedy for any breach to the value of replacing or repairing the prize awarded, to the fullest extent possible under the law.

8.4. With respect to this competition, except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of, relating to, or in any way connected with: (a) any technical difficulties or equipment malfunction (whether or not under The Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) any tax liability incurred by a winner or entrant.


9. General

9.1. This photography competition is conducted by ALPINE RESORTS VICTORIA (T/A MT BULLER & MT STIRLING RESORT MANAGEMENT) (“the Promoter”).

9.2. Entry into the competition deems acceptance of the Terms and Conditions.

9.3. To the extent of any inconsistency between the Terms and Conditions and other event information, the Terms and Conditions prevail. The Promoter reserves the right to amend these Terms and Conditions.

9.4. The Promoter reserves the right to postpone, cancel or suspend the competition. If such action is taken, entrants will be notified.

9.5. Entries that are found to breach these Terms and Conditions, will be considered invalid and, if awarded a prize, that prize must be returned to The Promoter.
